CANCELLATION POLICY:
- Any Booking deposits are non-refundable.
- Flight Tickets once issued are subject to Cancellation as per Airline Rules & Regulations.
- Hotel/Cruise/Transportation/Sightseeing Tours are subject to Service provider cancellation policies
Note that different cancellation conditions apply to some styles of trips. You are strongly advised to take out cancellation insurance at the time of booking. If you leave a trip for any reason after it has commenced, we are not obliged to make any refunds for unused services. If you fail to join a trip, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation terms are in addition to fees which may be levied by accommodation providers or third-party tour and transport operator fees.
PRIVACY POLICY:
Please note that the data shared with Embark N Explore ( ENE ) shall be primarily processed in India and such other jurisdictions where a third party engaged by ENE may process the data on ENE’s behalf. By agreeing to this policy, you are providing ENE with your explicit consent to process your personal information for the purpose(s) defined in this policy. The data protection regulations in India or such other jurisdictions mentioned above may differ from those of your country of residence.

TERMS & CONDITIONS;
RESPONSIBILITY OF THE EMBARK N EXPLORE
It is understood that the Embark N Explore will act as agents only for all services covered hereby. Further, the Embark N Explore shall not be responsible for any loss, injury or damage resulting from acts of God, fire, breakdown of machinery, equipment or vehicles, acts of government authority, wars, civil disturbances, riots, thefts, pilferage, epidemics, quarantines or any delays or changes including any extra expenses which the passenger may incur as a result of any of the foregoing causes.
- Scope of Services
Embark N Explore is in the business of selling a variety of travel related products from different suppliers and service providers (“Suppliers”). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them.
Embark N Explore is acting as intermediary or a “Booking Agent” for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, Visa etc.). We are not a co-vendor of such products and services. We are acting as an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our Suppliers as a result of this Agreement.
It is agreed that you had approached Embark N Explore for its services and the offer detailed above are being made on the basis of your requirement.
- Operational terms
- Our contract with Suppliers may allow them to cancel or amend bookings. As your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result.
- We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes. After you have left India, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to do this.
- Embark N Explore also reserves the right to make changes to the leisure / travel package after a confirmation has been issued. Such changes will normally be minor, but may be material in which case unless the same has been occasioned by a situation described in Clause 11, an alternative would be offered or refund of monies as detailed in Annexure A would be offered.
- In case of any unforeseen post-purchase price increases by supplier or levy of taxes by statutory authorities the same would be recoverable from you.
- Payments and Deposits
Any deposits from you are non-refundable.
Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. Price would generally be confirmed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.
The rates quoted are based on the average foreign exchange rates prevailing at the time of booking, which will also form part of the offer. Embark N Explore reserves the right to recover costs incurred by it on account of foreign currency fluctuations.
All taxes under the applicable laws will be charged / deducted and certificate of deduction provided where applicable.
- Client responsibilities
By booking your arrangement with us, you are agreeing to be bound by the terms of this Agreement, and any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.
Any amendment to the tour specifications after entering into this agreement would entail additional cost, which would be payable by you. Embark N Explore will make best efforts to provide the additional services but does not guarantee availability of the same.
You represent and warrant that (a) you are of sufficient age to use our services and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you or members of your group is true and correct. You are responsible for informing such other persons of all terms and conditions applicable to their travel arrangements. You understand that you are financially responsible for any use of our services and those using your name or account.
You shall be responsible to ensure that all members undertaking the travel are medically fit and have necessary medical clearances for travel. It is necessary part of this contract that you undertake to procure travel and medical insurance for all members of the travel team. It is recommended that the same may be procured through Embark N Explore or in the alternative Embark N Explore is informed of the details of the insurance policy.
You and all the members of the travelling team shall be responsible at all times for the safety of your belongings including personal effects except those specifically entrusted to our authorised representatives and in respect of which any receipts have been issued.
- Travel Documents
It is your responsibility to ensure that all of the details on your travel documents are correct and to bring to our attention any errors or discrepancies immediately.
It is your responsibility to fulfil the passport, visa and other immigration requirements applicable to your itinerary. You should confirm these with the relevant embassies and/or consulates. We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements or in case immigration authorities of any country/region refuse to provide the necessary visas / permits for travel.
- Indemnification
You agree to indemnify us and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party.
- Jurisdiction
This Agreement shall be governed by the laws of India and the Courts at Karnataka shall have exclusive jurisdiction to try a dispute arising out of or in relation to this Agreement.
- Severability
If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.
- Notices
All notices and other communications required or permitted to be served or given hereunder shall be by registered post to the Embark N Explore official address.
- FORCE MAJEURE
Embark N Explore shall not be liable for any delay in performing or failure to perform its obligations hereunder to the extent that such delay or failure results from natural hazards and / or disasters of force majeure or by labour unrest, riots, civil commotion’s, lockouts or by fire, flood, earthquakes, typhoons, war, acts of foreign enemies or other perils beyond the reasonable control of the Company or the Suppliers of the Company (“Event of Force Majeure”).
